{"id":1853,"date":"2022-07-12T10:47:54","date_gmt":"2022-07-12T09:47:54","guid":{"rendered":"https:\/\/www.socialdemocrats.ie\/housing-minister-must-explain-why-he-is-ramming-through-planning-amendments\/"},"modified":"2022-07-12T10:47:54","modified_gmt":"2022-07-12T09:47:54","slug":"housing-minister-must-explain-why-he-is-ramming-through-planning-amendments","status":"publish","type":"post","link":"https:\/\/www.socialdemocrats.ie\/ga\/housing-minister-must-explain-why-he-is-ramming-through-planning-amendments\/","title":{"rendered":"Housing Minister Must Explain Why He Is Ramming Through Planning Amendments"},"content":{"rendered":"<p><em><strong>The Minister must explain why he is going to guillotine this legislation with virtually no debate, no scrutiny and no oversight<\/strong><\/em><\/p>\n<p>Housing Minister Darragh O\u2019Brien must explain why he is ramming through planning amendments that will seriously limit the ability of the public to challenge decisions of An Bord Plean\u00e1la \u2013 in advance of reviews of either An Bord Plean\u00e1la or our planning laws being published, according to Social Democrats Housing Spokesperson Cian O\u2019Callaghan.<\/p>\n<p>\u201cAmendments to the Planning and Development Act 2000, which will seriously limit the ability of the public to judicially review decisions of An Bord Plean\u00e1la, were first published late on Thursday, July 7, and are due to be guillotined after a two-and-a-half hour D\u00e1il debate on Wednesday, July 13. This is no way to do business.<\/p>\n<p>\u201cAn Bord Plean\u00e1la has been mired in controversy for months, because of allegations concerning the behaviour of its former deputy chair, Paul Hyde and other members of the Board. Multiple reviews into these allegations \u2013 by senior counsel Remy Farrell, the Planning Regulator and An Bord Plean\u00e1la itself \u2013 are currently underway.<\/p>\n<p>\u201cSeparately, a comprehensive review of our planning laws is also underway, which the government has ostensibly commissioned to inform any forthcoming reform of our planning regime.<\/p>\n<p>\u201cIt is therefore bizarre that \u2013 before any of these myriad reviews has been completed \u2013 the government has published amendments that will significantly limit the ability of the public to challenge the decisions of An Bord Plean\u00e1la and intends to ram them through before the D\u00e1il rises for the summer.<\/p>\n<p>\u201cThere is no justification for this cavalier and reckless approach to legislating for such a significant matter &#8211; seriously limiting the public\u2019s access to justice in the courts. This is especially the case when multiple reviews into An Bord Plean\u00e1la, and our planning regime, have yet to be published.<\/p>\n<p>\u201cThe Minister must explain why he has pre-empted these reviews and published these amendments at such a late stage.
