{"id":2144,"date":"2023-06-27T11:12:29","date_gmt":"2023-06-27T10:12:29","guid":{"rendered":"https:\/\/www.socialdemocrats.ie\/government-amendment-could-hamper-investigations-into-data-breaches\/"},"modified":"2023-09-15T10:41:26","modified_gmt":"2023-09-15T09:41:26","slug":"government-amendment-could-hamper-investigations-into-data-breaches","status":"publish","type":"post","link":"https:\/\/www.socialdemocrats.ie\/ga\/government-amendment-could-hamper-investigations-into-data-breaches\/","title":{"rendered":"Government amendment could hamper investigations into data breaches"},"content":{"rendered":"<p><em><strong>How the Data Protection Commission goes about its tasks is already opaque<\/strong><\/em><\/p>\n<p>Social Democrats TD Catherine Murphy has criticised a Government amendment to a Justice Bill that would create confidential processes for data protection investigations.<\/p>\n<p>\u201cI share the concerns expressed today by the Irish Council for Civil Liberties (ICCL) in relation to the amendment proposed for the Courts and Civil Law (Miscellaneous Provisions) Bill 2022.<\/p>\n<p>\u201cThe language of the amendment gives the Data Protection Commission extremely broad powers to designate information as confidential \u2013 even information that is not commercially sensitive. This could make it more difficult to investigate big tech firms or public bodies in cases where they are misusing their data.<\/p>\n<p>\u201cHow the DPC goes about its tasks is already opaque. The commission is exempt from most Freedom of Information rules and does not hold public hearings. This amendment will make its work even less transparent.<\/p>\n<p>\u201cThe amendment may also conflict with forthcoming European law.
